Abstract

CORREA, Ivan. Justice and Law. Estud. psicanal. [online]. 2013, n.39, pp.53-57. ISSN 0100-3437.

In this essay, the author intends to contribute to clarify the misunderstanding that normally occurs with the meaning of Justice and Law. Starting with the analysis of certain facts which are part of our both national and international social conjuncture and contemporary politics, the aim of the essay is explored and enriched even more with the help of philosophers - especially from Plato, Kant and Hegel - and psychoanalysts - S. Freud and J. Lacan - whom provided significant contribution to understand the difference between Justice and Law. Therefore the author advocates that not everything that is legal is fair. The author also establishes the relation between justice and ethics and confirms Freud’s idea which states that only the psychic reactions related to ethics can salve humanity. The conclusion is optimistic and alludes to Hölderlin’s Anthem to Peace because it highlights the importance of taking into consideration the diversity in order to promote ethicality.

Keywords : Justice; Law; Ethics; Difference; Happiness.
