Abstract

This work presents many reflections about the problematic of children and youth in conflict with penal law. It describes many questions about the crime act in children and youths, it subjective place, the intersubjective, and the social place. It puntualizes the relationship between violence and vulnerability, and how the case to case put us face to face with children and youth with a high grade of vulnerability and helplessness. It considers that the crime act correspond with strategies of survival in which violence is like a form of recuperation of the one-self feeling, when the traumatic experience could not be transacted. It describes many ways of psychical positions from is been generated a transgressor act: from the law defiance to the desestimation of that one. In this work we wonder about if it is possible that the law´s dispositives could work as a place that could make possible the accession of the subjective responsibility. This work finishes with the asseveration that it can´t be thought the subjective reponsability without thinking the social responsibility.
