In Brazil, the social movement of gays, lesbians, bisexuals, transsexuals and transgenderes, or "LGBT people", was born of the need to unite voices in combating historical oppression against different expressions of sexuality and gender identities. The examination of the decisions of Brazilian Superior Courts involving the LGBT community allows an approximate study on how the Brazilian state behaves towards this population, considering the absence of legislative expression to govern their interests. In this article, with the theoretical framework "the struggle for recognition" and justice of Multiculturalism, the objective is to analyze critically the main legal disputes relating to rights of equalization and recognition for LGBT people, in the "Supremo Tribunal Federal (STF)" and "Superior Tribunal de Justiça (STJ)", from 2003 to 2013, in lawsuits involving the interests of LGBT people and their laws and administrative derivations.
