Abstract

The present study aims to identify the conceptions of legal operators on crimes of marital and extramarital sexual violence against women. The study included three operators of the Law: A Judge of a District, Attorney and a Public Defender, aged between 39 and 47 years. Semi-instructured interview was conducted and also presented a fictitious case of marital rape. The data were subjected to qualitative content analysis and found three categories: 1) insight into the marital sexual crimes, 2) insight into the extramarital sexual crimes committed by strangers and 3) comparison beside marital sexual crimes and extramarital sexual crimes. Different results were found, the more relevant is the perception that marital rape is mitigated by the double bond, while the outside of the conjugal was seen as something more aggressive. This research proved important to better understand how beliefs of legal operators can interfere how the law is applied with work within marital rape.
