Resumen

PORTO, Madge; DOS SANTOS, Maria Liliane Gomes  y  LEITE, Manoel Felix Araripe. Evaluación Psicológica como instrumento de acceso a la justicia en el contexto de la ley Maria da Penha (Ley 11.340/2006). Psicol. Am. Lat. [online]. 2010, n.19. ISSN 1870-350X.

The present study is the result of qualitative research in psychology, the initial objective of which was to become familiar with documents produced by psychologists in the context of the Maria da Penha Law based on Resolution nº 007/2003 Federal Psychology Council. With the absence of documents produced by psychologist in state processes and the impossibility of performing the intended analysis, the option was made to perform an analysis of the sentences pronounced by judges, in which a representative number of acquittals were found, which we associate to the lack of instruments that enable the materialization of crimes, especially psychological violence. Thus, the non-visibility of this resource is evident among the operators of the law as an important instrument capable of providing information and clarifying questions in cases of violence against women as well as psychological evaluation as an important instrument in the process of enforcement of the law and the full access of women to civil rights.

Palabras clave : Psychological Evaluation; Domestic Violence; Maria da Penha Law; Law; Gender.
