The present article is a study about the relations of gender and law in the history of contemporary Brazil. This is how we will begin an analysis of how, after the 1988 constitutional framework, it was possible to formulate bills that aim at the systematic withdrawal of women's rights, which were formally won by the constitutional movement of 1987. We will also ally with this analysis the questionings of what we call the judicialization of life, as well as a discussion of how the relation of subject of rights/social subjection in contemporary society can be given, reflections that will span the studies of Judith Butler and Michel Foucault. The article is divided into three parts: the first one to think about women`s rights and the attempt to withdraw them after 1988, then a brief passage in the state of art on the subject of rights and social subjection, according to the authors mentioned, and finally, an initial look at the bill that is the central topic of this thematic essay.
