The Child and Adolescent Statute generated advances in order to make the institutional sheltering a protective measure against the violation of the children and adolescents' rights. The latest report of the Brazilian situation accounts that violations of the law have been upheld, such as the lack of promotion of family life and the disregard of the emotional aspects of the child in relation to his/her family. The reality in Fortaleza is not different. Under the perspectives of psychoanalysis and law, the concepts of reality, causality, universality and uniqueness were analyzed with the goal of determining the impact of their understanding on the implementation of the protective measures. It was found that poverty was used by law enforcement to justify the detriment of the relationships between parents and their children, during the application of the protective measure. The psychoanalysis may contribute by introducing new elements to be considered when applying the measure, such as the place assumed by the subject within the family's structure.
