The article intends to systematize the theoretical divergence regarding the psychotic structure's moment of constitution. There are authors who claim that this structure is decided in adolescence, because they consider that the structure is linked to the organism's development. Others argue that psychogenetics is not the psychoanalysis' object of study, so the structure would not change according to chronological age. The first ones propose that the treatment's direction should be the inscription of the Name-of-the-father, and the second ones, that it should enable the construction of a supplementation. Besides that, this theoretical divergence implies different positions surrounding the law 13.438, which obligates pediatricians throughout Brazil to apply a psychic risk identification protocol. It is concluded that each thesis implies interventions in the clinical and political spheres, so that the way the theory is articulated is necessarily associated with an ethical position.
