Resumo

This work, based on the notion of limit formulated from the theory of Winnicott and understood as the capacity for concern, discusses the agency. The proposed notion of limit, shifting the idea of interdiction as a foundation of the process of subjectivation, is reinforced by anthropology, Sherry Ortner’s theory of practice, which conceives the production of social subjects through practice in the world and the production of the world through practice. Furthermore, this notion of limit is affirmed by the post- positivist view of the law, which stresses the interpretation of the rules by the rapprochement between law and ethics, emphasizes the principle of human dignity and sets up concern as a legal category. Such perspectives, applied to the analysis of the legal recognition of the right to exchange name and sex in the civil registry for transgender, allow to conceive the agency, to consider the historicity of subjects’ modes of action in culture and that of law itself and argue that the symbolic horizon is not untouchable. So, let discuss the possibilities of using the law, the expansion of its regulatory potential, the negotiation of limits and the reinvention of meanings by the subjects, as well as the ideas of contingency and historicity in psychoanalysis. Finally, it is suggested that to understand the diversity and uniqueness of human experience, it is necessary to consider the particularities of situations experienced and the shared notions of limit and capacity for concern.
