Abstract

ALVES, Karla Cristhina  and  SOUSA, Silas Prado de. A perversão sob a ótica da Medicina Legal. Reverso [online]. 2004, vol.26, n.51, pp. 85-89. ISSN 0102-7395.

Perversion from the medical-legal perspective The present paper looks to characterize the approach of Medical Law to perversion and its clashes with psychoanalysis, describing the important issues involved in this conflict. A bibliographic search was carried out in the database of MEDLINE employing the term perversion combined with the follo-wing: forensic psychiatry, psychoanalysis, paraphilias and sexual disturbances; no date limit was used. Independent of the line of investigation, a significant number of studies show that the Medical-Legal view of perversion is restricted to the area of sex. This is the result of a controversial historical process replete with moralism with respect to sexuality. Psychoanalysis questions this reductionist view, offering itself as instrument of especial importance in the characterization of perversion as a complex of structures in human beings. In spite of enlarging the conceptual reach of the term perversion throughout history, to Medical Law perversion has a purely sexual nature, characterizing the so-called perversion as sexual, from the legal point of view. Such a position insists in leaving psychoanalysis and the true ethical questions involved out of the debate.
