This article approaches the history of the asylums for the criminal insane from an anthropological perspective, particularly the foundation in Rio de Janeiro of the Hospital de Custódia e Tratamento Psiquiátrico Heitor Carrilho, the first Brazilian institution of this kind. The focus is on the social construction of the criminally insane and on how this ambiguous figure was connected to the historical debates about the social meanings of crime and the public interventions supposed to deal with deviant behaviors. Special attention is dedicated to the way criminological theories were incorporated by Brazilian courts and how this problematic incorporation led to the creation of the new asylum.
