The present work handles with reflections about childhood and youth Brazilian, the imaginary which recovers it, as well as the macro and micro social actions, among these are included circuits of circulation in public spaces. An approach clipping for childhood and youth in situation of social exclusion, specially the children, adolescents and young in street situation. The matter of living in the streets is an historical theme, with different causal bases, which assumes, however, in the contemporaneity, complex configurations which demand a gamma of State and society actions for its understanding, intervention and “control”. In the legal scope the guideline of the human rights has been the way through which respect, protection and effectiveness of institutionalized rights are doubted. We discuss on difficulty of implanting a culture of rights in a society which has been characterized by inequality, as the Brazilian society, as well as the law insufficiency in the scope of the rights, to include the complex liminar phase of youth, in special of the poor young persons. For this analysis a research on the referred bibliographical production on the subject in study was carried, applying our experience at action field with this population.
