The article studies the political-philosophical concern about the miserable migrants in the contemporary era, as a new object of administrative management of the States and of regulation of the established political order. The objective is to appropriate the notions of "management of illegalisms" and "governmentalization of the State", introduced by Foucault, to point out how they transform migratory politics into migratory police. Through the practice of illegalism, the management of these migrants uses infra-legal mechanisms that highlight the limits of the traditional relationship between legality and illegality. Through the modus operandi of governmentalization, the State regulates the migratory flow as a compensatory mechanism to mask the decline of its political sovereignty. With this, the insufficiency of the legal designation of the State with regard to the treatment of migrants is pointed out. In addition to Foucault's research, it is proposed to articulate the governmentalization of the modern state to the idea of "Waning Sovereignty", emphasized by Wendy Brown (2009). In this perspective of reading, the waning of the nation-state's political sovereignty is associated with the rise of the security state. And the "desire for walls" stimulated by the latter, shows the nostalgia for a state model that no longer exists. Thus, the production of the poor immigrant as an enemy of the nation results from a social defense mechanism undertaken by the security state, in the face of an alleged security that is permanently threatened. Despite this, this desire for security is never fully satisfied.
