Abstract

The following article is about the situation of imprisoned women in Brazil basing on two important official reports, one of which produced by the Ministerial Working Group - Grupo de Trabalho Interministerial -, the other Center for Justice and International Law - Centro Pela Justiça e pelo Direito Internacional (CEJIL), and entities that make up the Study Group and the Working Women Prisoners in order to reach the project and implementation of the Reference Center for the Pregnant Incarcerated by the Prison System of Minas Gerais State located in Vespasiano, a metropolitan area of Belo Horizonte City. Psychoanalysis is the direction through which some considerations are made since the issue can be seen from different angles. The focus is on the imprisoned mother, most of them charged by drug abuse, the woman distressed by both family and partner, and the close partnership mother and child are subjected to. Segregation and violence come as articulators from the reflections since they are inherent within the situation. Father, mother and their children matter - within the hypermodern reality - is put into consideration since many bibliographies about incarcerated women usually mention their incarceration losses into their family context. It is inevitable ascertaining about such reality in which the mother has become an essential figure of authority since it can no longer be said that women surround as interchange alliance object between men. The egalitarian ideal has come to the real with the decline of the paternalistic law. Even though it is complex to mention a gaining in such a change in course since both hierarchy and symbolically places set have become fragile. Thus, it isn't a privilege by the imprisoned women the fact of being the unique stable partner of their children even if that might lead them to a difficult life and has a significant and subjective consequence.
