ABSTRACT This work aimed to understand the violence scene in Brazilian prisons through the photographs from the Judge Sidnei Brzuska, exposed in his Facebook, and relations with affections of phobia and fear, which are predominant in Brazil's culture. For this, the way in which the capitalist discourse makes the social tie and its reflections in the mentioned context was analyzed. The methodology used was based on psychoanalytic theory and on its support pillar: transference. It was concluded that the capitalist system proposes a way in which law and life's value legitimize the precariousness of the experience of the people that inhabit the prison.
