Based on Social Constructionism, five grandparents were interviewed in order to understand how their discursive practices are intertwined with the litigation process regarding the custody of grandchildren. Accordingly, it was understood that the discursive practice can be an interesting methodological resource for psychological assessment, by making it possible to understand the psychological organization of individuals, at certain moments in their lives. In the case of these grandparents, it was possible to understand how their discursive practices present in the children's litigation were related to psychological, social and judicial issues. This understanding made it possible to recognize the psychic illness of the grandparents and, in this circumstance, strengthened the aggravation of the litigation and guaranteed its parental power.
