In this paper we present research on the relationship among law, crime and guilt. The perspectives of Psychoanalysis and Law in which the approach to crimes are different. Authors in the field of Law approach the criminal action from a rational point of view, in contrast to the psychoanalyst's perspective that highlights its unconscious determination. The psychoanalytic concept of the superego allows us to consider some crimes as passages to action in which the unconscious request for punishment has a central role. The novel by Dostoievski, Crime and punishment is used to articulate the main character’s experiences to the torments provoked by the action of the superego
