The progressive discharge (PD) is a benefit granted by the Judiciary to patients who are complying with security measure in a judiciary asylum. This is a discharge practice that aims the social reintegration of the individuals considered irresponsible and who committed delicts. This article aims to present the history and the main concepts guiding the PD, besides outlining the characteristics of this practice, its procedures and stages. It will be addressed theoretical aspects on the appearance of the PD, its characterization and its relationship to the psychiatric reform. This gradual discharge can be considered as a therapeutic tool for the treatment and evaluation of the patients, means of criminal recidivism control, and it serves as a model for the custody hospitals of the country.
