This study aims to learn what the conceptions assigned to parental responsibility and the father's place in the family, as well what the challenges regarding fatherhood in daily work of professionals working in family courts. Therefore, data were collected through semi-structured interviews of judges and prosecutors, analyzed according to the assumptions of thematic content analysis. Reports indicate a new look at paternity, while traditional concepts still prevail. Moreover, we noticed that joint custody has found resistance within the judiciary, which suggests that to overcome the view that the mother is better prepared to care for children and recognize the father someone who can share parenting more than just provide financially for the family, seems to be the challenge for all.
