Abstract

RORATO, Ângela; GIONGO, Cláudia  and  FLEISCHMANN, Simone Tassinari Cardoso. The functioning of mediation: construction of the Brazilian conception. Pensando fam. [online]. 2021, vol.25, n.1, pp. 127-137. ISSN 1679-494X.

Conflict mediation has been gaining prominence in Brasil since law 13.140/15 was promulgated to regulate its procedure. Since a large percentage of Brazilian society is unaware of this methodology, this article aims to present and reflect upon, through literature review, two epistemological trends of the method following the way mediation is being developed in Brazil, as well as to explore what can be expected of a mediation procedure when implemented in either way. Reflection and analysis about the procedure were chosen for both judicial and emancipatory mediation to address the similarities between the two approaches. Moreover, this article guides graduating mediators looking for ways of conducting the process while considering the importance of the principles of autonomy and responsibility regarding the mediation participants' choices.

Keywords : Conflict mediation; Emancipatory mediation; Procedure.
