With the publication of the New Joint Custody Law, this type of custody has come to be understood as the regime to be applied, aiming at the balance between parents and mothers, separated, in the exercise of co-parenting. Therefore, this study aimed to comprehend the understanding of legal operators about the applicability of joint custody, and the new possibilities and challenges that arise from it. For that, a qualitative research was carried out, with four judges and four promoters, who work in the state of Rio Grande do Sul. The research used semi-structured interviews and the analysis of data was done through Content Analysis. The main results point to the lack of a single concept of joint custody. The operators of Law still refer to the absence of accompaniment of the experiences of the families with joint custody, and at the same time perceive its importance.
