Abstract

Conciliation is the most effective means of resolving legal disputes to be voluntary act, and it is less expensive and faster, and enable the restoration of relationship. In legal conflict there is a difficulty in communication between the parties, because their anxious, their disarray and disturbance in their perception of the facts, it is fundamental to the intervention of anyone to act as a conciliator. This study, extracted from the literature review, presenting innovative methodology Reconciliation Humanist, based on the theory of Person-Centered Approach of Carl Rogers, which enables the magistrate as a facilitator of dialogue, directing him to adopt attitudes of empathy, genuineness and unconditional acceptance. The conciliator humanist provides an opportunity to speak to each participant, listens actively and genuine each repudiates judgments or criticisms expressed, act with empathy and authenticity, in a climate of cooperation and mutuality. In the final considerations are invited to rethink about the postures adopted by the magistrates during the conciliatory proposal, suggesting a qualification in judicial activity, to promote freedom of thought, speech and the flow of jurisdictional active listening, facilitating conscious and responsible choices as a result the resumption of dialogue.
