This article is a report of an academic research, funded by FIP/PUC Minas, which investigated the public policy of the social name usage by students transvestites and transsexuals in municipal schools of Belo Horizonte. Social name means the name by which transvestites and transsexuals prefer to be called daily, once the civil name does not reflect their gender identity. The research had the post structuralist theories of gender as epistemological support and as methodological strategy the document analysis of the Resolução CME/BH nº 002/08 and of the Parecer CME/BH nº 052/08, both produced by the Municipal Council of Education of Belo Horizonte, legitimating the use of the social name on education premises. Numerous textual and conceptual inconsistencies were found in the analyzed documents, undermining the internal logic of the legal provision. However, far from ideal, the social name brought the thematic to the human rights policy agenda.
