The article analyzes, from historical data and theoretical contributions, the changes in social practices against young considered "outlaw" in Brazil, since the days of the Empire. It is noteworthy that, despite legal advances, especially with the advent of the full protection paradigm, much remains to be done in the context of the implementation of policies. Defects were reported in the evaluation of public policies for youth in conflict with the law, that maintains the ideology of the rehabilitation process. In this context, although ineffective and counterproductive, practice of detention continues as the main strategy to solve the problem. It highlights the role of psychology and suggests that legal guidelines make reference to cultural and youth development processes.
