Abstract

DUNLEY, Glaucia Peixoto. Storm and drive (Sturm und Drang) in an international family alienation experience (Brazil / Switzerland). Trivium [online]. 2021, vol.13, n.1, pp. 112-134. ISSN 2176-4891.  http://dx.doi.org/10.18379/2176-4891.2021v1p.112.

This article sustains the importance of parental alienation law, necessarily expanded to family alienation law, as legal instrument that tries to make brazilian family law more just. By means of this law, and the storm and urge it has been arousing, the text aims to deconstruct the dominant legal rationalism, searching for a just right, permeable to the pathos of those involved, present in psychoanalytic listening and in the tragic occidental sources of law and psychoanalysis. It also highlights the importance of the essential separation between law and justice made by Derrida in Force of Law - The mystical foundation of authority. Finally, this article brings a fragment of my personal struggle as an alienated grandmother.

Keywords : FAMILIY ALIENATION; PSYCHOANALYSIS; LAW; JUSTICE; SOPHOCLES.
