From a psychoanalytical perspective, we intend to discuss the family’s place in the public policies aimed at protection of children and adolescents and in the speech of those who operate such policies, with emphasis on institutional care home or shelter. Through analysis of legal documents, specifically the Statute of the Child and Adolescent (1990/2009) and the National Plan for Promotion, Protection and Defense of the Right of the Child and the Adolescent Family and Community Coexistence (2006), and speech of employees of the shelters, we draw attention to the insistence on a patriarchal nuclear family model that operates at an unconscious level as the main agent of relations between children, shelter’s employees and State.
