The present text writes in the political, juridical and social transformations which have affected the constitution of the state punishment apparatus system in Brazil. Chiefly, one intends to reflect over the enforcement of prison penalty as well as its changes along history up to nowadays. By the same token - and adopting as analytical axis the different dimensions of the lived and prescribed - one aims at reflecting about the relationship between the alternations of political regimens- from the empire until the republic - and its effects on the imprisonment application as a central punishment instrument within the Brazilian criminal justice.
