This paper addresses the current controversies surrounding the anticipation of the age of criminal responsibility of adolescents in conflict with the law in Brazil, in order to provide a critical counterpoint to the approaches of conservative and punishing nature tending to change the penal liability predicted in the Child and Adolescent Statute (Law 8069/90) and in the article 228 of the Federal Constitution of 1998. The analyses exposed in the fallowing are based on studies performed by researchers specialized in criminology and social sciences throughout the national area and they rest upon reflections resulting from recently collected data regarding the Juvenile Court practices in our country. The text aims at possible alternatives in view of the ontense campaigns moved by oficial and parlamentary mediums in favor of the reduction of the penal majority in Brazil and focuses on the point of view that such a change would increase the selective criminalization processo of young Brazilians and neglect the real legal treatment applied on young people who get into conflicts with the law of our country.
