The purpose of this research is to understand how gender issues appear in cases of violence against women in the jurisprudence of Alagoas. The documents used in this analysis were obtained from the website of the Alagoas State Court of Justice, through the descriptor "violence against woman." The discussion was inspired by the methodological tools of Michel Foucault. We formulated two axes including the main points found in the jurisprudence: 1) victim and offender: subverting gender categories through judicial decisions; (2) nutcases and saints: construction of male and female identity through psy knowledges. In general, the legal materials end up triggering fixed categories of gender, where women emerge as victim and man as aggressor, formulating subjectivities framed by the judicial logic. The analysis points to the necessity to consider the consolidation of the Maria da Penha Law, not only for heterosexual relationships, but in a broad sense, to subvert the fixed categories of gender and sexuality found in the jurisprudence.
