In times of social and political regression, in which the argument for the institutionalization of poor and black youth gain increasing strength, it makes sense to question its constitution and interrelations. These arguments renew the tutelary and punitive character historically constructed around this youth, provoking restlessness before political discourses that lead to the institutionalization of the aforementioned public. The process of detainment in two institutions destined to the care of children and teenagers reveals the similarities between the justifications for the institutionalization in shelters and psychiatric facilities. The stories found in both institutions serve as a stage for questions regarding youth institutionalization in shelters and psychiatric hospitals today. In confronting these stories and the contemporary legislation on the care of children and youth, we propose reflections on the scars left by a long history of of criminalization of poor youth in Brazil, which persists until today.
