This study belongs to its author’s master’s dissertation, in which, by problematizing the category of the unimputable criminal, questions the productions of truth that arise from the encounter between law and psi knowledge formalized in the psycho-legal discipline. By making visible the cracks in the process of judging and diagnosing the unaccountable subject, the problem-questions regarding the category of imputable criminal are also visible, questioning the very foundation of this imputability, guilt, which will define a way of being a subject as ideal. In this context, psi knowledge supports these constructions of truth, contributing to the continuity of a structure of punishment supported fundamentally by racism. It is concluded, the impossibility of reforming this structure, requiring the creation other ways to address the issues raised by the conflicts between people. Thus, a repositioning of psychology becomes essential, ceasing to exercise a justifying function of the penal system and offering itself to build these other responses-path.
