Abstract

This study describes some of the results of research with 15 “dissident” magistrates that investigated the psychosocial conditions that reflected in the legal practices of such minority positions. Findings related the perception of this magistrature about how the objective configuration of the Brazilian judicial organization acts to consolidate a subjective hegemonic structure in the jurisdictional production. Overall, two central aspects are emphasized: the “managerial” parameters in the microdevices to regulate legal practices analogous to those that regulate the production of corporations in society and an “institutional perversion” in the judicial organization to conform even initiatives contrary to the hegemonic production, consolidating a neoliberal rationality. Thus, psychosocial influences have power over the judicial production and can transform the magistrature into a political instrument to legitimize injustice.
