From the cases of Pierre Rivière and of Timothy Mc Veigh, we argue the ideal of the human rights, born with the French Revolution, in counterposition to the citizen rights in the democratic current States. We focalize the function of the State and the implication of the law in the delimitation of the frontiers established between the subjects of full rights and the other which are included in the social space only by the fixation to a place of exclusion. Besides, we support that, countless times, these socially invisible subjects do not dispose of any resource inside the law to be heard and the violence presents itself as the only alternative, a subjectivation form payed, very often, with the death of other or the self death.
