Abstract

With psychoanalysis, a brief allusion is made to the classical reference for the principle of innocence presumption, to deal with its later legal institute in nascent liberalism, in the post-war period and in its modern validity. It is expected that this analysis can bring relevant elements of reflection on what can make possible the idea of its flexibility in contemporary societies, marked by the development of the alliance between science and capital.
